This course provides awareness of the Deprivation of Liberty Safeguards

Course Objectives
To ensure students can understand the principles involved with and awareness of the Deprivation of Liberty Safeguards.

Welcome and introduction, followed by:

Background and overview
The key principles of the Mental Capacity Act 2005
What is deprivation of liberty
Overview of the Deprivation of Liberty standards and how these relate to the rest MCA
Duties of Care Homes and Hospitals (managing authorities)
Duties of Local Authorities and PCT’s (supervisory bodies)
Standard and urgent authorisation
The assessment process / choice of assessors
Assessment process
Action to be taken if any assessment is negative
Responsibilities of the managing authority and the commissioner of care if a
   request for an authorisation is turned down
Duties of managing authorities and supervisory bodies while an authorisation is in force
Reporting concerns
Role of the Court of Protection
Monitoring the safeguards

The training will be based around case scenarios and practical application of the Act.
